What is the Certificate of Lawful Development ?

A Certificate of Lawful Development is a document that states the lawfulness of the past, current or future use of the property or operations. With this certificate, you can prove your development is lawful and it’s accepted by the Local Planning Authority. For that matter, it will increase your property’s value for future uses, mortgaging, etc.

How many types of Certificates of Lawful Developments are there?

There are 2 types of lawful development certificates:

It certifies the lawfulness of existing uses or noncompliance with a planning requirement.

 

Certificate of Lawful Development for Proposed Use

 



It certifies the lawfulness of proposed uses or operations and proves that it does not need planning permission.

Keep in mind that the certificate of lawful development is not a type of planning permission. Therefore, it cannot protect your development from enforcement actions if the use of the property changed materially without an application. But this certificate can help for future uses when you want to sell your property if your development is certified as lawful.

A certificate of lawful development might also be used in circumstances such as when the specific nature of the present use is difficult to describe. (secondary uses, multiple uses, subdivision, etc.)
